Terms of Service

1. Who this agreement is between
These Terms of Service ("Terms") are an agreement between Own The Field LLC ("Own The Field," "we," "us"), an Arizona limited liability company, and the business or individual signing up for the Own The Field service ("Customer," "you"). By creating an account, you agree to these Terms.
2. What the service is
Own The Field is a web-based customer relationship management (CRM) platform built for field service businesses (HVAC, electrical, plumbing, and other trades) to manage customers, jobs, quotes, invoices, scheduling, and related business operations. Each Customer's data is stored in its own isolated database — we don't pool or mix data between different Customers' accounts.
3. Accounts and eligibility
- You must be at least 18 years old and able to form a binding contract to sign up.
- You're responsible for everyone you give a login to under your account (employees, contractors) and for what they do with it.
- You're responsible for keeping your login credentials confidential. Tell us right away if you think an account has been compromised.
- One account per business. You won't create multiple accounts to get around plan limits or promotional offers.
4. Subscription, billing, and cancellation
- Plans and pricing are as shown at signup (currently Starter / Team / Growth — see pricing page). Prices are subject to change with 30 days' notice to existing Customers.
- Add-on services priced around a specific third-party cost (once launched: SMS/text messaging) may have their pricing adjusted separately from your subscription plan price, including in response to changes in what our messaging/telecom infrastructure providers (e.g., Twilio) or mobile carriers charge us to send messages on your behalf. Because these are pass-through cost adjustments rather than discretionary repricing, we'll give at least 14 days' notice before such a change takes effect (shorter than the 30-day general notice above), and any increase will be reasonably proportional to the underlying cost increase being passed through — we won't use a vendor's fee change as an opportunity to raise add-on pricing beyond that.
- Billing is handled by Stripe. By subscribing, you authorize recurring charges to your payment method until you cancel.
- To cancel, email hello@getownthefield.com. We process cancellation requests within 3 business days. There is no self-serve cancel button in the app. Cancellation stops future billing; it does not retroactively refund the current billing period unless required by law.
- After cancellation, you get 7 days of read-only access to export your data before your account is locked. After that, continued access requires resubscribing.
- We may suspend or terminate accounts for non-payment, abuse, violation of these Terms, or illegal use, with notice where practical.
5. Your data
- You own your data. Customer records, job history, invoices, and everything else you put into Own The Field belong to you, not us.
- We act as a data processor for the customer and business information you store in the app — see the Privacy Policy below for how we handle it.
- You can export your data at any time (including during the post-cancellation grace period) via the built-in backup/export feature.
- If your account is fully locked out and not reactivated, we will retain your data for 30 days after the account locks, then permanently delete it.
6. Acceptable use
You won't use Own The Field to:
- Store or transmit unlawful, fraudulent, or infringing content.
- Attempt to breach, probe, or disrupt the security of the service, or access another Customer's data without authorization.
- Resell, sublicense, or white-label the service without a separate written agreement.
- Send unsolicited bulk messages (spam) through any messaging feature (including SMS) to recipients who haven't consented.
7. Service availability
We aim for high uptime but don't guarantee the service will be uninterrupted or error-free. Scheduled maintenance and unplanned outages can happen.
8. Third-party services
Own The Field relies on third-party infrastructure to operate, currently including Stripe (payments), Render (hosting), Twilio (SMS/text messaging, once launched), Google/Gmail (transactional email — password resets, notifications), and Anthropic (AI assistant, when enabled). Your use of the service may also be subject to those providers' own terms, to the extent they apply to data passing through them.
9. Limitation of liability
To the maximum extent permitted by law: Own The Field is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages (like lost profits or lost business) arising from your use of the service. Our total liability for any claim is limited to the greater of (a) one hundred US dollars ($100), or (b) the amount you paid us in the 12 months before the claim arose.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by email or an in-app notice before they take effect. Continued use after changes take effect means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles, matching Own The Field LLC's state of formation.
12. Dispute resolution — binding arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, rather than in court — except that either party may bring an individual claim in small claims court if it qualifies, or seek injunctive relief in court to prevent actual or threatened infringement, misappropriation, or violation of a party's intellectual property or confidentiality rights.
YOU AND OWN THE FIELD EACH AGREE THAT ANY ARBITRATION WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Neither you nor we will participate in a class action or class-wide arbitration for any claims covered by this agreement.
You may opt out of this arbitration and class-action-waiver agreement by sending written notice to hello@getownthefield.com within 30 days of first accepting these Terms. Opting out doesn't affect any other part of these Terms, which remain in full force.
